Project records and warranties are retained for a minimum of ten years from the date of service completion. Financial and billing records are retained for seven years in accordance with IRS requirements. Newsletter subscription data is retained until you unsubscribe or request deletion. Website usage data is typically retained for twenty-four months. When your data is no longer needed, we will securely delete or anonymize it in accordance with our data retention schedule.
10. Your Rights Under State Privacy Laws. Depending on your state of residence, you may have specific rights regarding your personal information. Residents of California have rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information is collected, the right to delete personal information, the right to correct inaccurate personal information, the right to opt out of the sale or sharing of personal information, the right to limit the use of sensitive personal information, and the right to non-discrimination for exercising these rights. However, some of our service providers and cloud hosting partners may process data outside the United States. 13. Do Not Track Signals. Some web browsers offer a "Do Not Track" (DNT) feature that signals to websites that a user does not want to be tracked. There is currently no industry consensus on how websites should respond to DNT signals. At this time, Fix Up Your Place does not respond to DNT browser signals. However, we honor the opt-out preferences you set through our cookie consent tool and your email subscription preferences, which provide you with meaningful control over tracking and communications.
14. California Shine the Light Law. Under California Civil Code Section 1798.83 (the "Shine the Light" law), California residents who have provided personal information to a business with whom they have an established business relationship may request information about whether the business has disclosed their personal information to any third parties for the third parties' direct marketing purposes during the preceding calendar year. 15. Biometric Information. Certain Fix Up Your Place security services may involve the collection of biometric identifiers such as facial recognition data, fingerprint data, or voice prints when you opt into smart home security features. If we collect biometric information, we comply with applicable state biometric information privacy laws, including the Illinois Biometric Information Privacy Act (BIPA). We will obtain your explicit written consent before collecting any biometric data, inform you of the specific purpose and duration for which the data will be collected, stored, and used, and never sell, trade, or otherwise profit from your biometric information.
Terms and Conditions for Fix Up Your Place
16. Acceptance of Terms. By accessing the Fix Up Your Place website, using our mobile applications, or engaging our home services, you agree to be bound by these Terms and Conditions ("Terms"), along with our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use our services. These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Fix Up Your Place, Inc., a USA corporation with its principal place of business at 565 West Dr, Severna Park, MD 21146, USA. We reserve the right to modify these Terms at any time, and your continued use of our services after any changes constitutes acceptance of the revised Terms.
17. Service Descriptions and Scope. Fix Up Your Place provides a comprehensive range of home services including but not limited to interior design, exterior design, home decor consultation, bathroom remodeling, kitchen remodeling, fire and safety installations, solar panel installations, home warranty plans, roofing installations, gutter installations, and home security system installations. All services are provided in accordance with applicable federal, state, and local building codes, zoning regulations, and industry standards. The specific scope of work for each project will be defined in a written service agreement or project proposal provided to you before work commences. We reserve the right to refuse service to any person or for any project that falls outside our areas of expertise or that violates applicable laws.
18. Estimates, Quotes, and Pricing. All estimates and quotes provided by Fix Up Your Place are valid for thirty (30) days from the date of issuance unless otherwise stated in writing. Estimates are based on the information available at the time and may be subject to change if project specifications are modified, unforeseen conditions are discovered (such as hidden water damage, structural issues, or code violations), or material costs fluctuate significantly. In the event of any price change exceeding ten percent (10%) of the original estimate, we will obtain your written approval before proceeding. Final pricing will be confirmed in the service agreement. All prices are quoted in U.S. dollars and do not include applicable sales tax, permit fees, or HOA approval fees, which are the responsibility of the Customer unless otherwise stated.
19. Payment Terms and Conditions. Payment terms are specified in each individual service agreement. Unless otherwise agreed in writing, the standard payment schedule is as follows: thirty percent (30%) deposit upon signing the service agreement; forty percent (40%) upon commencement of the primary work phase; and the remaining thirty percent (30%) upon substantial completion and customer satisfaction confirmation. For projects exceeding fifty thousand dollars ($50,000), custom payment milestones will be established. Payments may be made by credit card (Visa, Mastercard, American Express, Discover), ACH bank transfer, certified check, or personal check (subject to clearance). Late payments are subject to a finance charge of one and one-half percent (1.5%) per month on the outstanding balance. Fix Up Your Place reserves the right to suspend work for accounts that are more than fifteen (15) days past due.
20. Cancellation and Refund Policy. You may cancel a service agreement within three (3) business days of signing without penalty, in accordance with the Federal Trade Commission's Cooling-Off Rule for contracts signed at your home. After the three-day cancellation period, cancellation fees may apply as follows: cancellations made more than fourteen (14) days before the scheduled start date are subject to a ten percent (10%) administrative fee; cancellations made seven (7) to fourteen (14) days before the start date are subject to a twenty-five percent (25%) fee; cancellations made less than seven (7) days before the start date are subject to a fee equal to the deposit amount, as materials may have been ordered and labor scheduled. Refunds, when applicable, will be processed within thirty (30) business days to the original payment method. For home warranty plans, a pro-rata refund may be issued based on the unused portion of the warranty period, minus any claims paid.
21. Warranties and Guarantees. Fix Up Your Place provides a five (5) year workmanship warranty on all installation and remodeling services, beginning from the date of substantial completion. This warranty covers defects in workmanship that manifest under normal use and service conditions. Manufacturer warranties on materials, fixtures, and appliances are passed through to the Customer and vary by product (typically one (1) to twenty-five (25) years). Our home warranty plans provide coverage as specified in the separate warranty plan document, including terms, covered systems and appliances, service call fees, and claim limits. All warranties are void if the Customer or a third party modifies, abuses, or fails to maintain the completed work in accordance with our provided maintenance guidelines. Warranty claims must be reported in writing within thirty (30) days of discovering the defect.
22. Customer Responsibilities. As the homeowner, you acknowledge and agree to the following responsibilities: ensure clear and safe access to the work area for our technicians and subcontractors; obtain any required Homeowner Association (HOA) approvals before work commences; disclose any known conditions that may affect the project, including but not limited to asbestos, lead paint, mold, structural deficiencies, or previous unpermitted work; remove personal belongings and furnishings from the work area or arrange for their protection; make timely payments in accordance with the agreed payment schedule; promptly communicate any concerns, changes, or decisions to your assigned project manager; and maintain the completed work in accordance with any provided maintenance instructions to preserve warranty coverage.
23. Permits and Code Compliance. Fix Up Your Place is responsible for obtaining all necessary building permits for work performed under our service agreements, unless otherwise specified. Permit fees are the responsibility of the Customer and will be included in the project estimate or billed separately. All work will be performed in compliance with the International Building Code (IBC), International Residential Code (IRC), National Electrical Code (NEC), and applicable state and local amendments. We will schedule and coordinate all required inspections with the local building department. The Customer agrees that if the Customer performs any work themselves or through another contractor that affects the systems or areas covered by our warranty, our warranty for those affected systems or areas shall be void.
24. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Fix Up Your Place SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, INCONVENIENCE, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATED TO OUR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO A SERVICE AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY THE CUSTOMER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. This limitation of liability applies to the fullest extent permitted by state law, and some states may not allow the exclusion or limitation of certain damages, in which case our liability shall be limited to the maximum extent permitted.
25. Indemnification. You agree to indemnify, defend, and hold harmless Fix Up Your Place, Inc., its officers, directors, employees, agents, subcontractors, and affiliates from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your breach of these Terms; your failure to disclose known conditions affecting the project; any modifications you or a third party make to our completed work; any violation of applicable laws, ordinances, or regulations by you or on your property; and any personal injury or property damage caused by your negligence or the negligence of any third party not under our direct control. This indemnification obligation shall survive the termination or expiration of any service agreement.
26. Insurance and Bonding. Fix Up Your Place maintains comprehensive general liability insurance with a minimum coverage of five million dollars ($5,000,000) per occurrence, workers' compensation insurance as required by state law, professional liability (errors and omissions) insurance, and commercial auto insurance for all company vehicles. We are bonded as required by individual state licensing requirements. Certificates of insurance are available upon request. Our insurance coverage is primary and non-contributory with respect to any insurance maintained by the Customer. In the event of property damage or personal injury caused by our negligence, you agree to first look to our insurance coverage for recovery.
27. Force Majeure. Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond the party's reasonable control, including but not limited to: acts of God, natural disasters (hurricanes, earthquakes, floods, tornadoes), pandemics or epidemics, government actions or orders, wars, terrorism, civil unrest, labor disputes or strikes, supply chain disruptions, material shortages, transportation delays, utility failures, or extreme weather conditions. If a force majeure event continues for more than sixty (60) consecutive days, either party may terminate the affected service agreement without liability, and the Customer shall be responsible for payment for all work completed and materials delivered to date.
28. Dispute Resolution and Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the county where the project is located or, for non-project-related disputes, in USA. The arbitrator may award any relief that a court of competent jurisdiction could award, including injunctive relief. The arbitrator's decision shall be final and binding, and judgment may be entered in any court having jurisdiction. Each party shall bear its own attorneys' fees and costs, unless the arbitrator determines that a claim was brought in bad faith or was frivolous. NOTWITHSTANDING THE FOREGOING, EITHER PARTY MAY SEEK INJUNCTIVE OR EQUITABLE RELIEF IN ANY COURT OF COMPETENT JURISDICTION TO PREVENT IRREPARABLE HARM.
29. Intellectual Property. All content on the Fix Up Your Place website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of Fix Up Your Place, Inc. or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our website without our prior written consent, except as expressly permitted by these Terms. The Fix Up Your Place name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Fix Up Your Place, Inc. and may not be used without our prior written permission.
30. General Provisions and Governing Law. These Terms shall be governed by and construed in accordance with the laws of the USA, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. No waiver of any provision of these Terms shall constitute a waiver of any other provision or of the same provision on any future occasion. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign our rights and obligations under these Terms without restriction. These Terms constitute the entire agreement between you and Fix Up Your Place regarding the subject matter hereof and supersede all prior or contemporaneous agreements, representations, and understandings.
